E & U Wins Trial and Recovers $456,000 in Disability Case!

E & U lawyers Charlie Firth and Sue Fischer were victorious in a trial in St. Paul doing great work on behalf of our disabled client. The client brought claims of disability discrimination, retaliation and failure to accommodate pursuant to the Minnesota Human Rights Act against her former employer. The Court awarded E & U’s client double backpay and emotional distress damages in addition to punitive damages, attorneys’ fees, costs and interest dating back to when her case began. Firth reports that the Court “appeared to be impressed with how unreasonably the employer treated the client after she reported her disability and tried to work with an accommodation.”

Employers should take note that quick decisions on these issues without careful consideration of accommodation issues and issues related to terminating a disabled employee can be costly. E & U represents employers and employees and has the background and ability to provide effective advice so employers may avoid these types of expensive mistakes. E & U developed Respect Effect, a training tool for employers to guide them through day-to-day employment issues. Fischer states that “employers who understand their legal obligations and effectively communicate with employees are better able to manage these situations resulting in benefits to both the employer and employee.”
